Police alleged that all the accused connived with private individuals to make false representation at the bank, when officials of the bank were engaged with their normal auction exercise.
The first prosecution witness, Ibrahim Bah who was supposed to commence testimony in respect of the matter before the court, could not go on, as lead counsel for the accused persons, H M Gavoe informed the court that the fourth accused, was ill disposed, and that the court should allow his client to seek medical attention.
But prior to that lawyer Gavoe had raised an objection during previous proceedings that the charges preferred against all accused persons could not be found in the country’s law books, therefore the court should discharged the matter with immediate effect.
His objection was overruled by magistrate Albert Moody, on the grounds that the charges preferred against his clients, were properly before the court, and that proceedings should go on.
The court later sustained the submission of lawyer Gavoe for his client to access medical care, and the presiding magistrate wasted no time to grant the orders, and went on to adjourn the matter to 6 September 2017, for further proceedings.
