Barrister Sentus Macauley who represented David Fornah at the Supreme Court of Sierra Leone on Thursday 29 March 2018 moved a notice of motion dated 28 March 2018, on behalf of his client, seeking the court’s discontinuance of the said matter.

He also withdrew court action against the National Electoral Commission and the rest of the defendants involved the matter; while his application was supported by David Fornah.

In his reply, Lawyer Dr. Abdulai Conteh who represented Dr. Kandeh Kolleh Yumkella stated that Counsel for the Plaintiff, Sentus Macauley was trying to make a mountain out of an ant hill.

He informed the court that his client had long ago renounced his American citizenship and that, since the plaintiff had advised himself to withdraw the matter, he would canvass the court to levy heavy costs on the defendant.

Lawyer Yasmin Jusu Sheriff who represented the National Grand Coalition responded that Counsel for the Plaintiff failed to advise his client, before instituting such court action that adversely affected the National Grand Coalition.

She further intimated the court that the Supreme Court should set a precedent by levying cost on the Plaintiff, so as to put an end to such court action that has no basis with unsubstantial evidence.

The Supreme Court judges informed Counsel representing all parties in the action that they will consider the application for cost and will send notices to them.

The five Judges that presided over the matter were Justice Nicolas Browne- Marke, Justice Eku Roberts, Justice Alusine Sesay, Justice Glenna Thompson and Justice Sengu Koroma.
