In his testimony, Detective Police Constable DPC Sheku Jusufu who is attached to the Criminal Investigation Department branch of Hastings Police Stations disclosed that, he recognized both accused persons, the Complainant, Sulaiman Kuyateh and recalled 26 July 2016.

DPC Sheku Jusufu further disclosed that on the above stated date, he was on duty at the Hastings Police Station, when Complainant, Sulaiman Kuyateh went and reported a case of house breaking and larceny including the disappearance of seventy eight bags of chicken food items against accused persons.

He also testified that, upon the strength of the information and report, the Scene of Crime Officer,519 Inspector  James Kamara led a team of police personnel to the scene of crime and took photographs of the damaged warehouse which were later produced, identified and tendered in evidence.

The witness narrated that on the same date, Detective Police Constable 10896 Sesay M including him, obtained voluntary caution statements from accused persons in respect of the alleged theft, which he had attempted to tender in evidence, but that, Counsel for accused persons, P.K Amara objected to the tendering of 2^nd accused, voluntary caution statements.

He argued that, the 2^nd accused person, Saidu Bangura statement should not be tender in evidence, on the grounds that,  his responses to police are in complete variance with what the police record in their evidence gathering posture, but he was overruled by Magistrate Binneh on legal grounds that, two witnesses have already led evidence and counsel should not now object to the tendering of 2^nd accused person statement, adding that Counsel has ample time to make such objection in the High Court and the court has adduced sufficient evidence for accused persons to stand trial in the High Court of Sierra Leone in respect of the charges preferred against them.

He continued that, a Search Warrant was also endorsed and executed at the residence of the 2^nd accused, Saidu Bangura at a place called New London in Kosso Town, and in the process items of police interest were found including seven empty bags of chicken food items which the Complainant claimed to be his property.

Accused persons have already been granted bail.

However, Counsel for accused persons, P.K. Amara has told the court that, he intends to submit a no case to answer on behalf of his Clients and Magistrate Dr. Abubakar Binneh Kamara has adjourned the matter to 13 September 2016.
