They are charged with the offences of Conspiracy to Murder, contrary to Section (4) of the Offences against Persons Act of 1861 of the laws of Sierra Leone and Murder, also contrary to law.

Led in evidence by the State Prosecutor, J.A.K. Sesay, the fourth prosecution witness, Abdulai Sesay told the court that he is Police Sergeant 2365 Sesay A.D. attached to the Criminal Investigation Department Branch at the Adonkia Police Station.  .

He said he recognized the six accused persons in the dock. He added that he also recognized his co-investigator – Unissa Tarawalie and further recalled the incident of Sunday 9th April 2017.

According to the witness, on the day in question he was on duty at the Criminal Investigation Department Branch at Adonkia Police Station, together with his co-investigator Unissa Tarawalie when they investigated the first accused person, Sylvester Fonnie by obtaining statement from him in respect of the alleged murder of Mohamed Kabba Kargbo.

The witness went on to say that the police also obtained voluntary caution statements from all six accused persons, and the accused persons later validated their statements by appending their right hand thumb prints.

He stated that after obtaining statements from the accused persons separately, they finally charged them with the offence of Conspiracy to Commit Murder and Murder.

The first accused persons, Sylvester Fonnie is said to have told police that he is a politician and member of the opposition All People’s Congress party.

He intimated that on the day of the alleged murder of Mohamed Kabba Kargbo, he was travelling from Bo, when he received a telephone call from one Mustapha informing him about the presence of unknown individuals who were doing some work on the land in question.

He also told police that on arrival in Freetown he informed Alhaji Dodondo Bangura and the National Secretary General of the opposition All People Congress party, Ambassador Alhaji Foday Osman Yansaneh, who advised him to stay calm and quite.

 According to Sylvester Fonnie he is also the chairman of a Development Committee within the Metchem community, and that the said organization had requested for the land in question from the National Secretary General of the All People’s Congress Party.

He said he was not present at the crime scene where the alleged murder took place, but later visited the deceased, Mohamed Kabba Kargbo at the Emergency Surgical Hospital, where Mohamed Kabba Kargbo succumbed to death.

The statement of the accused person Sylvester Fonnie was produced and tendered in evidence, and at the end of the trial process, the presiding judge, Hon. Justice Monfred Sesay ordered that the six accused persons be relocated at the Male Correctional Centre at Pademba Road in Freetown.

The six alleged murderers were defended by lawyer, J.J. Campbell and C. Sawyer.
