In his testimony, the prosecution witness, Detective Police Constable Mohamed Alie Mansaray attached to the Criminal Investigation Department branch at the Kissy Police Division in Freetown said he recognized both the complainant and the accused person.

He remembered Wednesday 6 September 2017. HE SAID whiles on duty at his station, the complainant arrested and brought in the accused and reported a case of Larceny and Fraudulent Conversion against the accused person.

The witness testified that the accused later confessed that the stolen bike was in custody of his friend at City Road, Wellington, but whiles he, his co- investigator 16694 Alimamy Conteh the complainant and the accused were on the way to City Road, he said the accused attempted to escape, and as result of this they had course to return to the station.

He disclosed that they also obtained voluntary caution statement from the accused by observing the judges rule, which the accused accepted to be true and correct by signing it in his own hand writing, which he produced and tendered in evidence.

Police Constable Mansaray continued that on 7 September 2017, the accused led them to the residence of one Sylvanus at Baibureh Road in Freetown, who he claimed was in custody of the stolen motorbike, but they it also could not be found.

He stated that on 13 September 2017, he charged the accused Desmond Fatoma Kamara with the offence of Larceny and Fraudulent Conversion, and that of the charged statement of the accused was witnessed by detective police constable Ahmid Kamara, whiles he signed as the recorder and the voluntary caution statement has since been in the police custody.

Magistrate Mohamed Serray Wurie adjourned the matter to Friday 13 October 2017, and ordered for the accused be relocated to the Male Correctional Centre in Freetown.
