The petitioner, David Fornah instituted court action against Dr. Kandeh Kolleh Yumkella on allegations that he (Dr. Yumkella) holds a USA and Sierra Leone passports, which is contrary to law and which disqualifies him from contesting for president.
In his petition, David Fornah claimed that the National Grand Coalition leader (NGC) cannot be holder of passports normally issued to applicants from two different countries.
He stated that such action by Dr. Kandeh Yumkella contravenes the national constitution and that therefore, he (Dr. Yumkella) should be disqualified from taking part in the country’s forthcoming general elections.
The matter was supposed to be adjudicated by five Supreme Court judges yesterday, but none of the judges were present at the Supreme Court. This development left lawyers representing the defendants Dr. Kandeh Yumkella and co- defendants frustrated.
One of the counsels for the defendant, Yasmin Jusu Sheriff told journalists that they were informed by the Registrar of the Supreme Court that the matter had been adjourned to today Thursday 1st March, 2018.
She further disclosed that counsel for the key defendant, Dr. Kandeh Yumkella was present in court, a representative of the Attorney General including counsel representing the National Electoral Commission (NEC).
Lawyer Yasmin Jusu Sheriff further disclosed that the petitioner, David Fornah and his legal representatives were conspicuously absent in court, and that this was a concern to them, especially as the country is fast approaching the March 7, 2018 presidential, parliamentary and local council elections.
