He is charged with the offence of Sexual Penetration of a Child, contrary to Section (19) of the Sexual Offences Act No.12 of 2012.

 

Police alleged that the accused person committed the offence on Friday 6th April 2018 at Angola Town, Goderich in the Freetown Judicial District in the Western Area of the Republic of Sierra Leone.

 

The accused person, Abdul Nahim Lansana who is nineteen years old is said to have penetrated the sex organ of an eleven years old child. He was arrested by detective police constable 13451 Sesay M. on 8th January 2019.

 

Explaining her ordeal to the court, the victim further narrated that she is a pupil and stays with her grandmother who shares the same residence with the accused person at Angola Town.

 

She told the court that she recognized the accused person in the dock Abdul Nahim Lansana (alias Bangla), and that on the day in question, she went to her grandmother at one of the intersections at Angola Town, where her grandmother is selling roasted peanuts (grannat).

 

According to the victim, she later returned home and went to bed, adding while she was in bed, she suddenly saw the accused person emerge in her room, took off her pant and penetrated his penis into her vagina.

 

She further explained that while the accused person Abdul Nahim Lansana alias Bangla was on top of her chest moving his waist up and down, he pulled out a black handled kitchen knife and threatened to kill her if she explained afterwards to anyone what had transpired between them.

 

The victim went on to say that, the accused person took to his heels when he heard the voice of the victim’s aunt coming towards her room. She added that the accused jumped over a nearby wall fence, leaving behind his knife, his slippers and ear phone.

 

She narrated that when her aunt entered into her room, she informed her that, the accused person Abdul Nahim Lansana alias Bangla had raped her.

 

The victim also explained to the court that her aunt later informed the town chief about the incident, who advised her to report the matter at the Adonkia Police Station.

 

Testifying in court, Detective Police Constable 13873 Foday Alusine Kanu stated that he is attached to the Adonkia Police Station as Exhibit Clerk.

 

He further stated that as Exhibit Clerk he is charged with the responsibility of registering cases and enquiry files and keeping them in safe custody.

 

The third prosecution witness said that on 14th April 2018, he was on duty at the Adonkia Police Station when detective Police Constable Sesay M. handed over to him, one assorted colored pant, a black handle kitchen knife, one pair slippers and ear phone.

 

The items, he said has since been in the custody of the police, before it was produced and tendered in evidence as part of the court record

 

The matter was prosecuted by Assistant Superintendent of Police, ASP Moses Moore.

 

Magistrate Abdul Sherriff adjourned the matter to tomorrow Tuesday 15th January, 2019.
