The accused, Hassine Benfrej is facing one count charge of Obtaining Credit by False Pretences contrary to Section (13) sub Section (1) of the Debtors Act of 1869, and that police alleged that between 7th November 2015 and 25 February 2016 the accused incurred bills at the Radisson Blu Mamy Yoko Hotel to the tune of one hundred and eighty two million six hundred and seventy four thousand seven hundred seventeen leones by means of fraud other than false pretence.

Led in evidence by the police prosecutor Assistant Superintendent of Police, ASP Samuel Kamara, the complainant who is also the General Manager of Raddison Blu Mammy Yoko Hotel, Nuno Neves told the court that, he recognized the accused person, Hassine Benfrej as his guest and recalled between 7th November 2015 and 25th February 2016.

Nuno Neves further disclosed that, the accused incurred the above stated amount at his Radisson Blu Mammy Yoko Hotel and before resolving to court action, he sent several reminder correspondences to the accused for him to honor the hotel bills, but that he reneged and therefore, he said he had no option but to take seek legal redress in a court of law.

He said he even reported the matter to the Criminal Investigation Department (CID) on Pademba road in Freetown and despite that, he said the accused could not honor his bills and went further to produce and tendered in evidence the correspondences he sent to the accused person as a reminder in respect the bills he incurred at the Raddison Blu Mammy Yoko Hotel.

At this juncture, the presiding Magistrate, Abubakar Binneh Kamara in his wisdom called for the matter to adjourned on the grounds that ,he would not allow the prosecution to continue to lead the witness in evidence due to the absence of  Counsels for the accused person.

He said the interest of the defense must be heard with regards to the tendering of documents by a witness in such a sensitive matter, as the defense might object to the contents of the document wanting to be tender in evidence.

 

The matter was adjourned to Tuesday 6th April 2016.
