 After the accused had pushed the deceased, he went on as he came down and saw the deceased lying helplessly with blood oozing from his ears, nostril  and mouth, stating that as result of the deceased condition, he immediately arrested the accused, and later contacted the deceased brother , who accompanied him , together with the accused to the Ross Road Police Station in Freetown,  after which the accused was detained,  in respect of the matter under adjudication.   

The witness had earlier told the court that he and the deceased returned from a popular night club called “Liberia Bar” situated along the Freetown Bai Bureh road in Freetown, adding that on their arrival at “up gun” intercession, they saw the accused in a furious posture with his friend, and wanted to exchange dry fist with his friend.

He also narrated that while, the former and the later were arguing , the former who is the accused, drew out a wooden stool, which the deceased elder brother usually  placed his business tray ,  and hit the deceased with it, thus leaving the wooden stool in a bad shape.

The witness also intimated his audience that the deceased and his elder brother later pounced on the accused, Alimamy Bangura to repair the wooden stool, but that the accused person vehemently refused to do so, by using sarcastic remarks, and went away.

Later on, he said the accused submerged at his residence, went upstairs and accused the deceased of been insolent and disrespectful, and concluded by stating that he was taken aback when; the accused surprising pushed the deceased from the two storey building.

The accused had no legal representation, and Magistrate Dr. Abubakar Binneh Kamara had adjourned the matter to toady 4 April 2017, for the testimony of the formal witness, before the matter will be committed to the High Court of Sierra Leone for further trial.
