The accused charge sheet further indicated that they murder the deceased  on 31 December 2017, at the residence of  Abess, at Beckley Lane ,Tengheh Town in the west end of Freetown, in the Freetown judicial district, in the Republic of Sierra, on 31 December 2014.

During the testimony of the tenth prosecution witness, Thaimu Kabbia before Justice Monfred Sesay, on Wednesday 31 May 2017, he disclosed that he was a private security guard to Abess at Beckley Lane and he only recognized the deceased, Daniel Salliue Kamara and the first accused person, Solomon Bondi as his co- guards to Abbess.

He told the court that he did not recognized the second accused person, Hector Sesay, and that he was charged with the responsibility of sweeping the compound, store water in various tanks, gateman and a generator attendant.

According to Thaimu Kabbia on the said date of the alleged incident, he was together with the deceased  Daniel Sallieu Kamara , Pa Thaimu Kargbo, who was also a guard to Abess and the first accused , Solomon Bondi, adding that before it was getting to midnight, the first accused abandoned the compound without their notice.

He further disclosed that since they could not ascertain the whereabouts of the first accused, and it was almost after midnight, he informed Pa Thaimu Kargbo and the deceased  that he was going to closed the main gate to the compound, and nobody should allowed him to enter the compound, until Abess returned home.

At this juncture, the witness maintained that the deceased told them to allow the first accused in the compound, if he reports back for duty, but that he would later complain him to their boss, in the person of Abess.

After that he returned to   the house and was nodding, when he heard a loud noise in the compound, adding that whiles he was moving towards the middle of the compound to ascertain what the problem was , he said he  came across Pa Thaimu Kargbo restless and  frightened.

At this juncture, the witness said he even enquired from Thaimu as to what the problem was, but that Pa Thaimu Kargbo responded that unknown men had gripped the deceased, Daniel Sallieu Kamara, stating that during the process, one of the assailants released gunshot and later opened sporadic firing.

Thaimu Kabbia narrated that as a result of this, him together with Pa Thaimu took refuge at the back of house near a pillar and a tank, and when they later came out of hiding after the unknown gun men had gone, they saw the deceased lying  in the pool of his own blood and started crying, after which the first accused person submerged into the compound with a deep cut on his leg bandaged, but that before the first accused abandoned the compound , he had no deep cut on his leg bandaged.

Later on, he stated a team of police personnel arrived on the scene of crime, and they were identified to the police officers as a guard to their boos,  Abess

He was also quoted to having said that after some time  Abess son called Amouday arrived at the compound, and realizing what had happened ,  He was  instructed by Amouday to accompanied two police officers to the residence of the deceased, nothing that two of the deceased brothers came along with them to the house and saw the remains of Daniel Salliue Kamara  lying dead.

The tenth prosecution witness concluded by stating that he,  Pa Thaimu Kargbo, including both accused persons were whisked to Operation Support Division Headquarter, where statement was obtained from him in respect of the matter currently in court.

Justice Monfred Sesay adjourned the matter to Wednesday 7 June 2017, and ordered that both accused persons be remanded at the Male Correctional Centre on Pademba road in Freetown
